Monsanto Ordered to Pay $289 Million to Dewayne Johnson, 46, as Jury Rules its Weedkiller Roundup Caused His Cancer

Monsanto suffered a major blow with a jury ruling that the company was liable for a terminally ill man’s cancer, awarding him $289 million in damages.

Dewayne Johnson, a 46-year-old former groundskeeper, won a huge victory in the landmark case on Friday, with the jury determining that Monsanto’s Roundup weedkiller caused his cancer and that the corporation failed to warn him of the health hazards from exposure. The jury further found that Monsanto “acted with malice or oppression”.

Johnson’s lawyers argued over the course of a month-long trial in San Francisco that Monsanto had “fought science” for years and targeted academics who spoke up about possible health risks of the herbicide product. Johnson was the first person to take the agrochemical corporation to trial over allegations that the chemical sold under the brand Roundup causes cancer.

In the extraordinary verdict, which Monsanto said it intends to appeal, the jury ruled that the company was responsible for “negligent failure” and knew or should have known that its product was “dangerous”.

“We were finally able to show the jury the secret, internal Monsanto documents proving that Monsanto has known for decades that … Roundup could cause cancer,” Johnson’s lawyer Brent Wisner said in a statement. The verdict, he added, sent a “message to Monsanto that its years of deception regarding Roundup is over and that they should put consumer safety first over profits”.

Speaking in San Francisco on Friday, Johnson said that the jury’s verdict is far bigger than his lawsuit. He said he hopes the case bolsters the thousands of similar lawsuits pending against the company and brings national attention to the issue.

Johnson’s case was particularly significant because a judge allowed his team to present scientific arguments. The dispute centered on glyphosate, which is the world’s most widely used herbicide. The verdict came a month after a federal judge ruled that cancer survivors or relatives of the deceased could bring similar claims forward in another trial.

During the lengthy trial, the plaintiff’s attorneys brought forward internal emails from Monsanto executives that they said demonstrated how the corporation repeatedly ignored experts’ warnings, sought favorable scientific analyses and helped to “ghostwrite” research that encouraged continued usage.

Everyone who owes fines and fees from criminal convictions in Orleans Parish must have the chance to plead poverty in a “neutral forum” before landing in jail for failing to pay, a federal judge ruled Friday.

Barring an appeal, the ruling from U.S. District Judge Sarah Vance marks the end of a three-year legal battle over the so-called “debtors’ prison” lawsuit brought by a handful of criminal convicts who were jailed for days or longer in Orleans Parish without a chance to prove they couldn’t afford to pay the fines and fees they owed.

Vance broadened the scope of the case Thursday with a 35-page order granting class-action status to anyone who owes court-issued fines and fees now or in the future.

On Friday, Vance declared that “undisputed evidence” shows the 13 judges of Orleans Parish Criminal District Court have “a policy or practice of not inquiring into criminal defendants’ ability to pay before those individuals are imprisoned for nonpayment of court debts.”

She also declared that the judges have an “institutional conflict of interest” in making such poverty determinations themselves. That’s because the proceeds from fines and fees go directly to the court’s Judicial Expense Fund, a kitty controlled by the judges that can be used for a broad range of judicial expenses. Fines and fees have contributed about $1 million a year to the court’s coffers.

Vance ruled that the court’s failure to “provide a neutral forum for determination of such persons’ ability to pay is unconstitutional.” The decision appears to leave it up to the court to decide how to set up a mechanism for such decisions.

Vance telegraphed her final ruling with a preliminary decision on key issues in the case in December.

On Friday, she cited a 1983 U.S. Supreme Court decision that found the 14th Amendment to the U.S. Constitution bars states from arresting or detaining a defendant solely for failing to pay court costs, without determining if that failure was willful.

For years, the Orleans Parish court’s collections department — and individual judges — routinely issued arrest warrants for people who failed to pay fines and fees assessed after a conviction. Civil rights groups claimed that practice created an “unconstitutional and unjust modern debtors’ prison.”

In response to the legal attack, court officials recalled thousands of arrest warrants issued solely on the basis of unpaid fines or fees, writing off about $1 million in debts in the process.

Other warrants remain in place, such as those involving failure to appear in court or lapsed restitution payments to victims. Vance settled most of the issues from the federal lawsuit in December. But on Thursday, she ruled that her decision applies to a broad class of people: everyone who now owes money from fines and fees, and everyone who will incur those debts in the future.

However, she threw out a separate claim by the plaintiffs, who argued that it is unconstitutional to jail people who fail to pay criminal fines when those who owe fines from civil judgments don’t face the same threat.

Regardless, attorneys for the plaintiffs claimed a big win Friday.

“This is a victory for the people of New Orleans and for those committed to fixing the breaks in the criminal justice system,” said Kristen Clarke, president and executive director of the Lawyers’ Committee for Civil Rights Under Law.

“America treats being poor as a crime, disproportionately victimizing people of color. This ruling ensures that people can no longer be thrown in jail in Orleans Parish for their poverty alone.”

OPINION: Why I’m Here For the Badass Black Women of San Diego Comic-Con 2018

As GBN’s resident biracial, millennial nerd, I place a lot of importance on diversity at Comic Con and in the entertainment industry.

Pop culture has the power to influence how people see the world around them, and, thankfully, there are people in the entertainment industry who understand this and work to make content that showcases the positive aspects of diversity and uniqueness.

A prime example of this content is Steven Universe, an out-of-this-world show that isn’t afraid to show just how diverse this planet really is.

On the surface, Steven Universe is a cartoon about a boy trying to save the world. But on a deeper level it’s a show about love and friendship, and a show that teaches kids lessons about healthy relationships, anxiety, and how important it is to be true to yourself. Estelle, who plays Garnet (the fierce leader of the Crystal gems and fusion of LGBTQ+ couple Ruby and Sapphire), killed it at the Superheroes of Body Positivity Panel this Comic Con.

Estelle, along with the rest of the Crewniverse (people who work on Steven Universe) recently participated in Dove’s Self Esteem Project. Rebecca Sugar, the creator of Steven Universe and Estelle joined Dove on the Panel to talk about body positivity and open up about their own experiences with body image. “My body works, it’s gorgeous. It gets me from point A to point B. If someone, doesn’t like my body, that’s too bad,” Estelle explained.

Another show featured at Comic-Con was Black Lightning, a badass superhero show that celebrates Black Americans. Series co-creator Mara Brock Akil took the stage to express that “celebrating our culture is important to remind us that we are also a part of the fabric of American culture. Tracking our history and our path is important.”

Then there are the women of the Women Who Kick Ass Panel. Amandla Stenberg, who I’ve been a fan of since their portrayal of Rue in The Hunger Games, said “The topic of ‘strong female roles’ is tricky. There’s an awareness I have. I create representation because of the accessibility I have. When it comes to roles there is a give and take time. We continue to sacrifice in order to see the representation we want.” I will definitely be purchasing a ticket for their new movie The Darkest Minds.

And of course, there’s Regina King, who will be starring in HBO’s new Watchmen series. “There weren’t many like me kicking ass. I was a Lynda Carter fan. Even though Wonder Woman was wearing a skimpy outfit, she had ownership and confidence that exuded female strength,” Regina King explained about her own experiences with superheroes.

For me, cartoons and superheroes have shaped core aspects of my personality and morality, so it means a lot to me to see so many badass women of color involved in so many amazing projects share their experiences.

The National Academy of Engineering has 83 new members this year. The new members bring the total number of U.S. members to 2,293. The new members will be inducted in a ceremony in Washington, D.C., on September 30.

Election to the National Academy of Engineering is among the highest professional distinctions accorded to an engineer. Academy membership honors those who have made outstanding contributions to “engineering research, practice, or education, including, where appropriate, significant contributions to the engineering literature” and to “the pioneering of new and developing fields of technology, making major advancements in traditional fields of engineering, or developing/ implementing innovative approaches to engineering education.”

The academy does not disclose the racial makeup of its membership, but past JBHE research has shown that Blacks make up about one percent of the members. According to an analysis of the new membership list by JBHE, it appears that there are three Black engineers among the 83 new members. Two of the three have current academic affiliations.

Lynden A. Archer is the James Friend Family Distinguished Professor of Engineering in the Smith School of Chemical and Biomolecular Engineering at Cornell University in Ithaca, New York. He joined the faculty at Cornell in 2000. Professor Archer was recognized by the academy for “advances in nanoparticle-polymer hybrid materials and in electrochemical energy storage technologies.” Dr. Archer is a graduate of the University of Southern California, where he majored in chemical engineering. He holds a Ph.D. in chemical engineering from Stanford University.

Gary S. May is the chancellor of the University of California, Davis. He became the seventh chancellor of the university in August 2017. Previously, he was dean of the College of Engineering at the Georgia Institute of Technology in Atlanta. Dr. May was selected to the academy for his “contributions to semiconductor manufacturing research and for innovations in educational programs for underrepresented groups in engineering. A native of St. Louis, Professor May is a graduate of the Georgia Institute of Technology, where he majored in electrical engineering. He holds a master’s degree and a Ph.D. in electrical engineering and computer science from the University of California, Berkeley.

The third African American in this year’s cohort of new members is Gabriel C. Ejebe, the senior project manager for energy trading and markets for Open Access Technology International in Minneapolis.

100 high school students to be selected for all-expenses-paid mentoring experience of a lifetime

LAKE BUENA VISTA, Fla. – Applications are being accepted now through Oct. 31, 2018, for the Disney Dreamers Academy with Steve Harvey and Essence magazine. This annual outside-the-classroom mentoring program is scheduled for March 21-24, 2019, at the Walt Disney Resort in Florida.

The program helps 100 select high school students, ages 13-19, from across the United States jump-start their life goals and pursue their dreams. Disney Dreamers Academy turns the entire magical setting of Walt Disney World into a vibrant classroom.

Students participate in a series of sessions and workshops designed to help them imagine bright futures, make exciting discoveries and learn how to put their goals into action. For more than a decade, Disney Dreamers Academy has inspired young people from across the country by fueling their dreams and showing them a world of possibilities as they prepare for the future.

Each year, students participate in hands-on, immersive career seminars in a wide range of disciplines found at Walt Disney World. LeBron James Opens I Promise School in Hometown of Akron for At-Risk Kids

As he drove to the school he was helping open in his hometown, LeBron James’ emotions brought him back to when he was the same age as the kids who were starting school there Monday.

He remembered school meaning nothing to him. He remembered it being too far away for him to get there, especially when his mother didn’t have a car. He missed 83 days of school in fourth grade. “It was a surprise to me when I woke up and I was actually going to school,” James said.

As he got older he learned about the value of an education, and how important that was to break poverty cycles. That’s why Monday mattered so much to James, the NBA’s biggest star who recently left Cleveland for the Lakers.

At 8 a.m., 240 at-risk third- and fourth-graders started at the I Promise School in Akron, Ohio. It is a public, non-charter school, just like the ones James attended as a child, but it seeks to offer all the things kids growing up like James did need to succeed. The LeBron James Family Foundation is the top donor and worked with Akron Public Schools to meet all its standards and regulations. And here, the staff attends to not just the children’s education, but also the outside factors that might interfere with that education.

The kids received high-fives from the staff. They begged their teachers to know if “Mr. LeBron” was going to visit their classrooms. Some parents who’d lost jobs asked if the school could help them find new ones. A homeless family asked if they could get help, too. The answers were yes, yes and yes.

“We are going to be that groundbreaking school that will be a nationally recognized model for urban and public school excellence,” said Brandi Davis, the principal. “We are letting people know that it is about true wraparound support. True family integration, true compassion.”

It began as an idea inside a monthly brainstorming session between James and Michele Campbell, the executive director of James’ foundation.

Sometimes her job is to manage the expectations of a man who believes, on and off the court, that he can accomplish anything. In this case, she let slip an idea he latched on to right away. Maybe their reach would improve if they created a school, she mused. “Well, why aren’t you doing that?” James asked.

She told him the foundation wasn’t ready for that kind of project. He told her to get started anyway. “There’s nothing that she can’t do,” James said. “If I tell her to go build a rocket and take it to outer space, Michele can make it happen.”

Like the early days of space travel, this was uncharted territory. The school district worked with the foundation. They brought together 120 stakeholders — parents, corporate sponsors, students, teachers, administrators and volunteers — to find out what students in their district really needed. Akron public schools are some of the lowest-performing in Ohio.

They settled on a program that helped teach the skills children need to handle trauma they see in their daily lives, combined with a hard math and science curriculum that would help further their education.

The school’s “wraparound” services help reduce stress kids might feel when their parents are struggling financially. That includes job and family services, a GED program, a food pantry from which they can shop and choose their meals, and help with housing if needed. They have a seven-week summer camp program to help avoid the trouble that comes with too much free time.

Every student gets a bicycle because when James was growing up, he used one to get away from the more dangerous parts of his community. The students also get a Chromebook to complete their homework. “I wanted to keep it as consistent and as authentic to when I was a kid,” James said, while adding generous touches and technology.

The children were randomly selected from a pool of Akron students whose reading levels were a year or two behind where they should be.

“And then we got to make these awesome phone calls to parents to say, ‘Hi, would you like to be a part of something new, something different? The I Promise School,’” said Keith Liechty-Clifford, the coordinator of school improvement for Akron Public Schools.

This renovated, stately brick building sits between a McDonald’s and a convenience store. Inspirational quotes wallpaper the interior and the entrance is decorated with James’ game-worn shoes, which will be sold as a fundraiser. Some walls are painted with murals of such figures as Martin Luther King Jr., Muhammad Ali and Jackie Robinson.

To truly provide emotional and psychological services for at-risk children and their families requires well-trained and supported teachers. The I Promise School gives teachers access to psychological services. Every Wednesday afternoon will be reserved for career development. James even hired a personal trainer to work with teachers who want a guided workout.

All their supplies also are provided by the school. That was a pleasant surprise for Angela Whorton, an intervention specialist at the I Promise School. She’s been a teacher for 10 years and almost always had to spend her own money to properly stock the classroom.

She’s spent her own money here, too, but for personal touches. She bought a black rug that functions like a red carpet and put stars on it so the students feel special walking into the room. The writing utensils in her room are topped with white artificial flowers.

From her classroom on the second floor, Whorton pointed out of a window to a neighboring home’s modest backyard. She moved to Akron when she was in eighth grade.

“Through those trees was my backyard,” Whorton said. “And I used to dream big. At the time my mom was struggling as a single parent. She promised us that if we had an education we could be and do anything we needed to be.”

When they didn’t have electricity, Whorton’s mom lit candles so she and her brother could do their homework. When the plant where she worked shut down, Whorton’s mom went back to school and took two jobs to care for her children. She’d stand in line at the food bank to make sure she had something to feed her kids.

Whorton knows just how valuable the school she works in can be in this community. Sunday afternoon her family got a closer look at the school and she couldn’t stop her tears.

“The family wraparound approach is going to help the community,” Whorton said. “Right from my window. Looking at my backyard where I used to dream. There’s nothing more electric than that.”

A two-hour ceremony followed the end of the first day of school. At its conclusion, James spoke to the crowd. He laughed at someone who shouted “wee wee,” his mother’s nickname growing up. He paused for a moment when a man in the back of the audience shouted, “We love you!”

University of Pennsylvania Professor Ebony Elizabeth Thomas Offers List of Children’s Books That Accurately Depict Slavery

Children in the U.S. are often introduced to America’s troubled and cruel history through movies, television programs, and children’s books. Historical fiction is frequently the means by which children learn about atrocities such as the enslavement of African Americans, racial segregation, Japanese-American internment, and the genocide of Native Americans.

Discourse about these topics in children’s literature can be difficult in light of the books’ overall function to inspire, transmit values, and spark young minds. But an omission or inaccurate portrayal of the crimes and suffering can do lasting societal damage to readers and how they see the world.

Ebony Elizabeth Thomas, an associate professor in the Graduate School of Education, has for the past decade been exploring representations of slavery in children’s literature. Over the last six years, she and her research team have compiled a database of 160 children’s books covering slavery that were published between 1970 and 2015—almost half of all the children’s books on slavery published in the 35-year period, many of which are no longer in print.

An expert on children’s literature and the teaching of African-American literature, history, and culture in K-12 classrooms, Thomas says parents, teachers, and educators must consider questions of readership, ethnicity, class, gender, story, background, intended audience, and difficulty when selecting books for their students.

Thomas supports the criteria put forth by scholar Rudine Sims Bishop that children’s literature about slavery should, in part, celebrate the strengths of the black family as a cultural institution and vehicle for survival, and bear witness to African Americans’ determined struggle for freedom, equality, and dignity.

Ashley Bryan’s “Freedom Over Me: Eleven Slaves, Their Lives and Dreams Brought to Life” is a book Thomas points to as one that successfully gives an accurate depiction of slavery, humanizing African Americans held in bondage while also conveying the truth and difficulty of slave life.

“I recommend this book. What you’re getting here is 11 slaves’ lives and dreams that are being brought to life by this author,” she says. “[Bryan] is representing their complexity in the illustrations, his writing of the poetry. I highly recommend this because it balances humanizing enslaved African Americans, but he’s also showing the complexity of their lives.”

On top of her 160-book database on slavery in children’s literature, Thomas is conducting reader response surveys in Philadelphia public schools, and has published two articles on representations of slavery in children’s books.

Thomas also praises “Underground: Finding the Light to Freedom” by Shane W. Evans; “All Different Now: Juneteenth, the First Day of Freedom” by Angela Johnson; “Freedom Song: The Story of Henry “Box” Brown” by Sally M. Walker; “Almost to Freedom” by Vaunda Micheaux Nelson; “The People Could Fly: The Picture Book” by Virginia Hamilton; and “Love Twelve Miles Long” by Glenda Armand.

Additionally, she is working on a book about slavery in children’s literature tentatively titled “Reading Racial History,” and she serves on the advisory board of Teaching Tolerance’s Teaching Hard History project.

Thomas says children’s literature is a prime site for social reproduction, and an unexamined site of social progress, regress, and/or transformation.

“If you have children’s media that’s regressive, and the children of today are going to be the adults of the mid-to-late 21st century, if we don’t change the children’s media that they’re being fed by, just like we still remember and talk about ‘Peter Pan,’ ‘Alice in Wonderland,’ and other fictions of the long-ago Victorian and Edwardian eras, they’re going to still be influenced by these current writings—from ‘Harry Potter’ to problematic books about slavery—deep into the 22nd century.”

Jordan Thomas Wins Harvard Debate Competition as He and 24 Other Students from Atlanta Make History

A group of 25 black students from Atlanta, competing against hundreds of young scholars from around the world, made history over the weekend with winning performances in a Harvard debate tournament.

Jordan Thomas, from Atlanta’s Grady High School, won the competition. He said in a press release that he “was determined to represent my city and my story. I wanted people to see where I came from and how I could keep up with them.”

“Being a young, middle class, black, public school student from the South created a stigma that automatically set me back in comparison to the competition, most of who were international students or from preparatory schools in the Northeast,” said Thomas.

“To bring the championship back to Atlanta was the most satisfying feeling, and to walk onto the campus of one of the most elite universities in the world and meet personal and council goals, brings a unique and new satisfaction that I’ve never experienced.”

The young scholars were the first backed by scholarships through the Atlanta-based Harvard Debate Council Diversity Project to participate in Harvard’s summer debate council residency.

Harvard Debate Council, which runs the annual summer program at the school’s campus in Cambridge, Massachusetts, divided nearly 400 participants, including high school students from Asia, Europe and Russia, into 12 teams for debate competitions.

The 25 Atlanta scholars, selected for Harvard Debate Council Diversity Project’s inaugural class from about 150 applicants, began the residency program with a daily, 10-hour academic regimen to learn research, analysis, argumentation and political science. Then, using their new skills, they were split into teams for the competition with other high school students from around the world.

Thomas described the project as “not a competition between each other, rather it is an incubator of intellect and a cultivator of brilliance.”

Notably, most of the Atlanta students were inexperienced debaters. They were from 16 different schools in the region. Brandon Fleming, a Harvard assistant debate coach who founded Harvard Debate Council Diversity Project, said the project aims to be a “pipeline that would recruit, train and send students of color to Harvard on full scholarship.”

Missing Writings from “The Autobiography of Malcolm X”, Long a Mystery, are Sold to Schomburg Center in NY

For a quarter century, they have been the stuff of myth among scholars: three missing chapters from “The Autobiography of Malcolm X,” reputedly cut from the manuscript after his assassination in 1965 because they were deemed too incendiary.

Their possible existence was first teased at in 1992, when a private collector at an estate sale scooped up material belonging to Alex Haley, Malcolm X’s collaborator on the book. Years later, one biographer was allowed a 15-minute look at some of the papers, but otherwise they have been mostly locked away, surrounded by a haze of cultivated mystery.

But now the unpublished material, or at least some of it, has suddenly emerged and was offered for sale Thursday at a Manhattan auction house, along with another artifact that scholars have never seen: the manuscript for the published book, which bears dense traces of Mr. Haley’s and Malcolm X’s complex negotiations over the finished text.

At the auction, an unpublished chapter called “The Negro” was picked up by the New York Public Library’s Schomburg Center for Research in Black Culture for $7,000. There were no offers on the manuscript for the published version, which had an opening minimum bid of $40,000.

But after some hushed conversations in side rooms, it was announced that the Schomburg — located on Malcolm X Boulevard in Harlem, and already home to a large collection of material that had been held by Malcolm X’s family — had acquired the manuscript for an undisclosed sum, along with nearly a dozen unpublished fragments that had also gone unsold.

“‘The Autobiography’ is one of the most important books of the 20th century,” Kevin Young, the director of the Schomburg, said after the auction. “To have the version with Malcolm X’s corrections, and to be able to see his thoughts taking shape, is incredibly powerful.”

The manuscripts were included in a sale of African-American historical artifacts by Guernsey’s auction house. The sale also included an item that had attracted considerable media interest in recent years: a Detroit house associated with Rosa Parks that had been bought by an artist, disassembled and shipped to Germany, then shipped back again for sale. (The house, which had a minimum price of $1 million, received no bids.)

But it was the appearance, with little advance fanfare, of the Malcolm X material that caused a stir among scholars, some of whom expressed alarm before the auction that manuscripts that had been locked away by one private collector might disappear into the hands of another.

Komozi Woodard, a professor of history at Sarah Lawrence College who is writing a book about the final year of Malcolm X’s life, said he was “shocked” when he learned about the auction earlier this week. “If we’re trying to figure out where Malcolm would have taken us, some of those papers have clues to that puzzle,” he said.

Since Malcolm X’s assassination there have been battles over the meaning of his life, in particular its tumultuous last year, when he broke with the Nation of Islam, traveled to the Middle East and renounced his philosophy of racial separatism.

There have been equally fierce battles over his literary remains. Papers removed from his family’s home by one of his daughters and later seized by owners of a storage facility were nearly auctioned in 2002, before scholars and family members organized an effort to have the collection placed intact at the Schomburg Center.

Gun control advocate Lucia “Lucy” McBath won the Democratic nomination for the U.S. House in Georgia’s 6th Congressional District.

McBath beat her Democratic opponent, businessman Kevin Abel, in Tuesday’s runoff after they finished as the top contenders in the state’s May primary but neither garnered the majority of the vote. She won 53.7 percent of the vote.

McBath thanked her supporters early Wednesday morning, saying she was at a “loss for words.” “We deserve better representation in DC, and I intend to show the good people of #GA06 what a tough, determined mother can do,” she wrote on Twitter. “On to November.”

McBath, a national spokeswoman for gun control group Moms Demand Action, will now face a challenging race against incumbent Rep. Karen Handel (R-Ga.) in November’s general election. Handel famously beat Democrat Jon Ossoff in last year’s special election ― the most expensive U.S. House race in history, with more than $50 million spent on both bids.

McBath was spurred into activism by the 2012 death of her son, Jordan Davis, a black 17-year-old who was shot dead at a Florida gas station by a white man complaining about loud music. Initially planning to run for a state House seat, McBath decided to run for Congress after the February school shooting in Parkland, Florida, that killed 17 people, most of them teens.

“I knew that I could no longer sit on the sidelines,” McBath wrote on her campaign site, “while the politicians in the pocket of the gun manufacturing lobby decide the future of our gun laws.”

She said Wednesday that Jordan was her “rock & inspiration” through the race.

As a “Mother of the Movement” ― part of a group of women who’ve lost a child to gun violence or in police custody ― McBath advocates for “common sense gun violence prevention laws,” including background checks, raising the age for firearm purchases to 21 years old and fighting against “conceal carry” measures. The two-time breast cancer survivor is also pushing for more affordable health care and improving women’s access to health services.
